harrassment/descrimination secondary to medical conditionPosted by Christine Patzkowsky on March 17, 2000 at 08:05:45:
My boyfriend (Adiren) has Charcott Marie Tooth disease. He is a native of Mexico who has been in this country for ten years, and is awaiting his appointment to take his oath of citizenship for the United States, (which is about a year overdue, thanks to the system's expedition of process). He has worked for over ten years in a convalescent hospital as a janitor. During his tenure he has received excellent annual reviews with no hint of problems either in reference to his preformance or his disability. He has performed all of the duties required with no time off except for a hernia operation and an operation to remove a lipoma form his back. Total time lost in ten years - one month. Recently, his supervisor, (who presents animosity toward Adrien) discovered that Adrien has CMT. The supervisor went to the administrator and both of them called Adrien in for a "meeting". The administrator stated that he could get Adrien off on disability. Adrien replied that he did not want to leave his job; he explained that he was waiting for his citizenship et al. Adrien presented a paper to the Administrator from his own doctor stating that there was no need at this time for disability. Another meeting was called, and this time the administrator told Adrien that he(the administrator) has a doctor friend who would write a note to Adrien's doctor "encouraging" him to put Adrien on state disability. If this were to come to pass, Adrien would lose his benefits, his income (we all know how much state disability pays.) He has two dependent children that he is still supporting in Mexico.
Adrien is an educated, intelligent man. He, like so many other latin people, is considered to be ignorant. This is not the case. We both want to know if this situation smacks of harrassment and discrimination. Could you please post a reply?
