IF you still have a chance at getting the job, then go to them and be TOTALLY HONEST. Tell them that this was over 7 years ago and you were informed by the judge and your attorny that after 7 years it would be removed from any public records. Also tell them you have had NO DUI's since then or have been involved in any other illegal activities, and that is why you omitted it. THEY SHOULD KNOW THAT EVERYONE DESERVES A 2ND CHANCE, ESPECIALLY SOMEONE WHO HAS DONE EVERYTHING TO GET THEIR LIFE BACK ON TRACK AND LEARNED THEIR LESSON 7 YEARS AGO! Tell them that you had NO intention of lying or deception, and that IF you had known that what you were told was untrue you would definitely have put it on the application. But because you were TOLD IT WOULD BE OMITTED FROM ALL RECORDS AFTER 7 YEARS, you believed what THE JUDGE AND COURTS TOLD YOU. HONESTY WITH THAT AND ALL POTENTIAL EMPLOYERS ABOUT THE ENTIRE SITUATION WILL TELL THEM MORE ABOUT YOUR CHARACTER THAN TRYING TO MAKE EXCUSES OR PUT THE BLAME ON OTHERS. Take responsibility for what happened, as they already know, even if they were not supposed to. At this point, your best bet is to TOTALY COME CLEAN ABOUT THIS to the potential employer. IF the employer has indicated to you that you have NO chance for the job, then you need to either hire an attorney or go to the people or attorney who represented you 7 years ago and tell them about this and MAKE SURE that IT IS REMOVED FROM ANY PUBLIC RECORD, and before applying for another position, (if the one you spoke of is no longer an option) Check it out yourself, because of the fact it IS A PUBLIC RECORD that they found the info on, YOU as a member of the PUBLIC also have access to that info. If you run into some jerk who says you can't access it, then simply go back to another person and say you are about to hire this person (put your name down) and say you would like to see if there are any DUI's or any arrests or convictions against this person. Then you will know if it is still there. BUT DO THIS after you have told the courts and/or attorneys who handled this and told you it would be removed after 7 years, tell them you were NOT HIRED because your "record" is still showing up despite the fact they told YOU IT WOULD NOT. Also you can contact your local ACLU FOR HELP (american civil liberties union) They may under certain circumstances help you even file a lawsuit against the STATE and/or the company who refused to hire you over the HONEST OMISSION. email me for further info if you like
