facial piercing

I would like to hear some feedback as to whether it is discriminatory to fire an associate simply because they refuse to take out the piercing. The employee was hired with the piercing, but the company has changed hands since the hiring. The employee did sign a form stating they new the new company's policy regarding facial piercing. any comments??
